On June 25, 2026, the Riverside County Superior Court granted summary judgment in favor of our client, a global retailer, in a negligence and premises liability action.

Plaintiff’s Complaint Allegations
The Plaintiff generally alleges that the walkway surface and premises of our client’s store were negligently maintained such that it created a dangerous condition causing the Plaintiff to fall.
Summary Judgment Motion
CPLG argued that the walkway surface where the Plaintiff fell was not a dangerous condition, and that the retailer did not have actual or constructive notice of any alleged hazard.
In support of the summary judgment motion, CPLG retained an expert to perform a coefficient of friction testing of the walkway surface where the Plaintiff fell. The testing found that the walkway surface was slip-resistant and exceeded industry standards.
Furthermore, CPLG submitted evidence that:
- The retailer conducted extensive floor walks and identified no hazards prior to the Plaintiff’s fall.
- The retailer’s employees did not receive any notice regarding a dangerous condition in the area where the Plaintiff fell.
- Video surveillance before and after the incident showed numerous customers walking through the area where the Plaintiff fell without any observable slip and falls occurring.
The Court’s Ruling
The Court found there was no triable issue of material fact that a dangerous condition exists, and that the retailer did not have any notice of the alleged hazard. Accordingly, the Court granted summary judgment in favor of our client.
