Owner of Vehicle that Struck and Killed CPLG Client’s Partner Denied Indemnity, Action Dismissed with Prejudice

On March 25, 2025, Colman Perkin Law Group successfully cleared our client of liability in a wrongful death lawsuit following a tragic and fatal accident that occurred in Los Angeles, California.

Our Client’s Wrongful Death Lawsuit

This lawsuit involved a multi-vehicle, multi-impact freeway accident. CPLG’s client was rear-ended on the freeway with her partner, the decedent, as a passenger in her vehicle.

The decedent safely exited the couple’s vehicle post-collision to inspect the damages and exchange information, when another vehicle struck the decedent, killing him.

The decedent’s survivors thereafter filed a wrongful death lawsuit against the owner of the vehicle that struck and killed him.

The Cross-Complainant’s Response

The vehicle’s owner then sought indemnity against our client, becoming the Cross-Complainant in this case.

If successful, this cross-complaint would have shifted liability in the matter to our client, the partner of the decedent.

Closing

Through asserting our strong basis for summary judgment, our attorneys successfully obtained a complete dismissal for our client with prejudice, clearing her of all liability to the Cross-Complainant’s indemnity action.
