CPLG Clears Concrete Company of Liability in Motor Vehicle Accident Case

On August 5, 2024, the Orange County Superior Court ruled favorably on a Colman Perkins Law Group Motion for Summary Judgment, granting our Motion in favor of our Client-Defendant and against the Plaintiff in the matter.

The lawsuit was defended by CPLG trial handling partner Jennifer M. Damon, and the Motion was argued in court by attorney Blake W. Berger. Both attorneys hail from our Orange County law offices located in Irvine, California.

The Plaintiffs claim

The subject lawsuit arose from a motor vehicle accident that allegedly occurred in 2017.

The Plaintiff filed an action for personal injury, claiming the driver of the Defendant’s vehicle and his employers were liable for her damages. She asserted baseless claims against our client.

Our contentions at trial

During the investigation and litigation, evidence arose that some of the other (adverse) defendants involved in the accident were using our client’s company name fraudulently and without our client’s authorization.

This resulted in the Plaintiff seeking to attach liability to our client for an accident that our client never knew about and was never involved in.

The decision

As a result of CPLG’s Motion for Summary Judgment, the Court was informed of the clear evidence showing our client:

  • was never involved in the Plaintiff’s accident
  • was not the employer of any drivers involved
  • did not own or operate any vehicles or equipment involved in the accident

Based on the lack of any evidence establishing the liability of our client for the Plaintiff’s accident or her resulting injuries, the Court granted our Motion and rendered summary judgment in favor of our client and against the Plaintiff on all of her Causes of Action.
