CPLG Clears Driver of Liability in Motorcycle Collision Case

On September 19, 2024, the San Luis Obispo County Superior Court ruled favorably on a Colman Perkins Law Group Motion for Summary Judgment, granting our Motion in favor of our Client-Defendant and against the Plaintiff.

CPLG trial partner Dan Everakes defended the lawsuit, and the Motion was brought to hearing by CPLG Law & Motion attorney, Dat-Vinh Nguyen. Both attorneys hail from our law office in Glendale, California.

The Plaintiff’s claim

This lawsuit concerned a motor vehicle accident that occurred in early 2017 involving a car-to-motorcycle collision. 

The Plaintiff filed his lawsuit against our client alleging negligence and claiming personal injury damages including Traumatic Brain Injury (TBI), hospital and medical expenses, wage loss, loss of earnings, and property damage to his motorcycle.

Our contentions at trial

During the investigation and litigation, it was determined that Plaintiff lacked evidence to support his claims of sustaining any injury or damages—whether to person or property—as a result of the 2017 accident.

The decision

In response to CPLG’s Motion for Summary Judgment, the Court made a final determination that the Plaintiff failed to show:

  • Any evidence he sustained monetary damages resulting from the 2017 accident
  • Evidence of treatment sought resulting from the 2017 accident
  • Evidence of wage or earning loss
  • Any evidence substantiating his property damages claim

Based on this, the Court granted summary judgment in favor of our client and against the Plaintiff. The grant of summary judgment effectively clears our client of liability in this lawsuit.
