The 2021 Combined Claims Conference in Orange County included a continuing education session on investor funded litigation. Part of the liability track of programming, the topic was presented by Glendale attorney Jon Colman of Colman Perkins Law Group.
His session, Investor Funded Litigation: Leveling the Playing Field or Funding the Takedown?, addressed the relatively new option of recruiting third-party investors for cases otherwise too costly for individuals. Jon warns that this approach is still evolving and requires a hard look at the legality and ethics of non-parties participating in matters that involve them only financially.
He also advised claims professionals to beware as they evaluate risk exposures and litigation expenses when unknown funders may be driving the case for their own benefit.
